GENERAL CONTRACTING CONDITIONS FOR ONLINE STORES
www.monicaecco.es (hereinafter, the Website) is a website owned by Monica Ecco Textil, SL, hereinafter the Owner, with CIF number: B88475736 and registered office at: Avda. Lazarejo, 6 - 28232 Las Rozas de Madrid, Madrid (Spain).
Access, reproduction and use of the Web services requires prior acceptance of the Conditions of Use in force at any given time; the Owner reserves the right to modify said Conditions whenever it deems appropriate, by publishing the new text on the Web.
It is the user's responsibility to be familiar with the Terms of Use before accessing the products and services on the Website. If you do not agree with them, please refrain from using the Website.
PROPERTY
The Web is a work composed of various integrated and inseparable elements (text, illustrations, photographs, animated images, videos, computer programs, including the website's HTML codes, etc.), whose Intellectual Property belongs to the Owner except with regard to those materials obtained under license from third parties.
The Owner and its licensors retain at all times the Intellectual Property over the Website and over the various elements that compose it, considered individually, in all copies made (whatever the medium on which they are incorporated), granting over them only the rights of use described below. Any right that is not expressly transferred is understood to be reserved.
In addition to the above, the Owner is responsible for the selection, design of the structure and arrangement of the contents of the Website, as well as the person who has taken the initiative and assumed the risk of making substantial investments aimed at obtaining, digitizing and presenting the same, and is therefore entitled to the protection that Article 12 and Title VIII of Book II of the Intellectual Property Law may grant to the website, considered as a database.
The owner is also the sole owner of the design and graphic image of the Web, reserving the relevant legal actions that may correspond to it against people who make imitations or unfair uses of it.
It is strictly prohibited:
- Any operations regarding the Web, its contents, downloaded products and copies thereof that are contrary to the Law, good customs and good faith.
- Any use outside the personal and private sphere, especially those for commercial or professional purposes, including the sending of advertising or messages and the collection and processing of third-party data.
- Any type of extraction, public communication and/or transmission, in whole or in part, by any means, outside the scope of permitted private use and, especially, its incorporation into any other work, including web pages, collections or databases.
- The operations and activities expressly prohibited in any other sections of these General Conditions and, in general, any that may harm the normal functioning of the Website, other users or any third party.
CONTENT AND USER BEHAVIOR
As a client or user of the Website, you agree to make appropriate use of the content and services offered through the Website and not to use them for:
- Engaging in illicit, illegal activities or activities contrary to good faith and public order.
- Disseminate content or propaganda of a racist, xenophobic, pornographic nature, that promotes terrorism or violates human rights.
- Cause damage to the physical and logical systems of the Owner, its suppliers or third parties, introduce or spread computer viruses or any other physical or logical systems that may cause the aforementioned damage.
- Disseminate content that threatens the image and reputation of the Owner or third parties.
- Violate the intellectual property rights, industrial rights, image rights, honor rights or others that belong to the Owner or third parties.
The Owner will have full freedom of decision as to whether the collaborations and messages are finally published on the Web or not, being authorized to remove them when deemed appropriate.
The infringement of any of the rules contained in these Conditions of Use and, in particular, of the provisions of this clause, will entitle the Owner to immediately cancel your membership as a user or subscriber of the Website.
PAYMENT METHODS AND PRICES
Service prices are expressed in Euros (€), including taxes and management and shipping costs, the amount of which will be indicated at the time of final confirmation of each order.
Once the form data has been completed, the User must proceed to pay for the order through the payment methods specified on the Website.
After payment is made, the User will receive an order confirmation email, which will include a summary of the items purchased, the requested shipping method and the destination address.
If at the time of making the payment an incident occurs that prevents the payment from being made, the User will receive an automatic payment error message and their order will not be processed until the payment process has been successfully completed.
DELIVERY TIMES
Orders can currently be placed for Spain (mainland) and the Balearic Islands. The Canary Islands will be opened shortly.
** There will be no charge for shipping your order when your purchase is over €30. When the order is less than €30, €4.50 will be charged for shipping.
Shipments are also made (at a cost of €16) to:
Germany, Austria, Belgium, Bulgaria, Croatia, Czech Republic, Denmark, Estonia, Finland, France, Greece, Hungary, Italy, Latvia, Lithuania, Luxembourg, Monaco, Netherlands, Portugal, Romania, Slovakia, Slovenia and Sweden.
Order delivery takes between 3-7 business days*
*understanding that Saturdays, Sundays and holidays are not considered working days.
We will tell you the usual process from when you place your order:
- The warehouse confirms the order (usually within 24 hours)
- The next business day the courier collects the order from the warehouse.
- The next day the order will be on its way to your home.
We always try to comply with these periods, but sometimes due to specific situations such as weather, special situations in the different destination places, etc., which depend on external agents, delays may arise. If you have any questions or queries about your order, you can write to us. to info@monicaecco.es .
IMPORTANT! Please check your order as soon as possible and make sure everything is correct.
If you are not at home at the time of delivery, don't worry. The courier will try to call you to arrange a new delivery. If they cannot reach you on the phone number you have provided, they will send you an email or text message informing you. You just have to follow the instructions and you will be able to arrange a new delivery with the courier the following day. This new delivery attempt can be made up to a maximum of 2 times, free of charge. If we do not receive a response within this period, your order will be returned to the warehouse of origin and we will refund the amount of your order using the same payment method used to pay for it.
RETURN AND WITHDRAWAL
Withdrawal
As a consumer and user, you have the right to withdraw from this contract within a period of 14 calendar days without the need for justification.
The withdrawal period is 14 days from receipt of the product. To exercise your right, download this form , fill it in and send it to info@monicaecco.es by email.
The return of goods entails collection costs if it is requested through the courier companies on the website.
The goods must be delivered in their original packaging and in perfect condition.
The refund will be made through the same payment method used by the customer for the initial transaction, never after 14 calendar days after the consumer expresses his desire to exercise the right of withdrawal and once the product has been received in our warehouses in accordance with article 107.1 RDL1 /2007.
Returns and exchanges
In the case of orders delivered in Spain (Peninsula) or the Balearic Islands.
To make returns and exchanges of orders you must follow the following process:
- You have a maximum period of 14 days from the delivery of the order to make the return or exchange.
- You must send an email to info@monicaecco.es , with the following details:
Order numbers (they appear in the emails that are sent to you when you make the purchase).
Indicate the product you wish to return, if there are several in the order.
Reason for change or return.
- Put the product back in its original box and wrap it well.
- We will send you a label to deliver the order to a post office.
- We will process your return and refund within the next 10 business days from when we receive the package at our warehouse. We will send a confirmation email when the refund has been processed.
- Return shipping costs are charged at €5, which will be deducted from the amount to be returned via the same method used to make the transaction.
If you notice that there is an error in the shipment or quality problems with the product, it is essential that you send an email with photos of the defect or problem with the shoe to info@monicaecco.es. In this case, the return will not have any associated cost, and the customer may decide whether to receive the correct product again or cancel their order and receive 100% of the amount of their purchase.
We will not issue a refund if the product is found to have been used upon arrival at our warehouses.
Orders delivered to other countries
To make returns and exchanges of orders you must follow the following process:
- You have a maximum period of 14 days from the delivery of the order to make the return or exchange.
- You must send an email to info@monicaecco.es , with the following details:
Order numbers (they appear in the emails that are sent to you when you make the purchase).
Indicate the product you wish to return, if there are several in the order.
Reason for change or return.
The customer will be responsible for sending the package, assuming all costs. We will not be responsible for it until the package arrives at our warehouses.
We will process your return and refund within the next 10 business days from when we receive the package at our warehouse. We will send a confirmation email when the refund has been processed.
APPLICABLE LAW, JURISDICTION AND CLAIMS
These Terms and Conditions are subject to Spanish law. The parties, in accordance with Royal Legislative Decree 1/2007, of November 16, approving the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, submit to the Courts and Tribunals of the User's place of residence.
Furthermore, pursuant to the provisions of Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on the resolution of online disputes for consumer matters, MONICA ECCO informs you that, in the event of a dispute, the User residing in the European Union may go to the “Online Conflict Resolution Platform” developed by the European Commission, which can be accessed from the following link: http://ec.europa.eu/consumers/odr/
DATA PROTECTION
The information or personal data that you provide us will be treated in accordance with the provisions of the Privacy Policy. By using this website, you consent to the processing of said information and data and declare that all the information or data that you provide us is true and corresponds to reality.
MODIFICATIONS
The information appearing on this Website is current as of the date of its last update. MONICA ECCO reserves the right to unilaterally modify these Terms and Conditions, as well as its privacy policy and any other information. The changes to the Terms and Conditions will come into effect from the moment they are published on this Website.
LINKS
The Website may include hyperlinks or links that allow access to websites of third parties other than MONICA ECCO, and which are therefore not operated by MONICA ECCO. These links are provided for information purposes only, without us having any control over the content of such websites or materials. Therefore, we do not accept any liability for any damage or loss arising from their use.
LEGAL ACTIONS
THE OWNER will pursue any breach of these Conditions of Use, as well as any improper use of the Website or its contents, any infringement of the rights that correspond to it or its licensors, especially those of Intellectual and Industrial Property, exercising all civil and criminal actions that may correspond to it by law.
