GENERAL CONTRACTING CONDITIONS FOR ONLINE STORES

www.monicaecco.es (hereinafter, the Website) is a website owned by Monica Ecco Textil, SL, hereinafter the Owner, with CIF number: B88475736 and registered office at: Avda. Lazarejo, 6 - 28232 Las Rozas de Madrid , Madrid Spain).

Access, reproduction and use of the Website services requires prior acceptance of the Conditions of Use in force at all times; The Owner reserves the right to modify these Conditions when it deems appropriate, by publishing the new text on the Website.

It is the user's responsibility to know the Conditions of Use before accessing the products and services on the Website; If you do not agree with them, we ask you to refrain from using it.

PROPERTY

The Website is a work composed of various integrated and inseparable elements (text, illustrations, photographs, animated images, videos, computer programs, including the html codes of the website, etc.), whose Intellectual Property corresponds to the Owner except regarding those materials obtained under license from third parties.

The Owner and its licensors retain at all times the Intellectual Property over the Website and over the different elements that compose it, individually considered, in all copies made (whatever the support to which they are incorporated), granting over them only the rights of use described below. Any right that is not expressly assigned is understood to be reserved.

In addition to the above, the Owner is responsible for the selection, design of the structure and layout of the contents of the Website, as well as who has taken the initiative and assumed the risk of making substantial investments aimed at obtaining, digitizing and presenting of the same, corresponding, therefore, to the protection that article 12 and Title VIII of Book II of the Intellectual Property Law may grant to the website, considered as a database.

The owner is also the sole owner of the design and graphic image of the Web, reserving the relevant legal actions that may apply against people who make imitations or unfair uses of it.

It is strictly prohibited:

  • Any operations regarding the Web, its contents, the downloaded products and copies of all of them that are contrary to the Law, good customs and good faith.
  • Any use outside the personal and private sphere, especially those for commercial or professional purposes, including sending advertising or messages and collecting and processing data from third parties.
  • Any type of extraction, public communication and/or transmission, total or partial, by any means, outside the private scope of permitted use and, especially, its incorporation into any other work, including web pages, collections or databases.
  • Operations and activities expressly prohibited in any other sections of these General Conditions and, in general, any that may harm the normal functioning of the Website, other users or any third party.

CONTENTS AND USER BEHAVIOR

As a client or user of the Website, you agree to make appropriate use of the contents and services offered through it and not to use them to:

  1. Involve in illicit, illegal activities or activities contrary to good faith and public order.
  2. Spread content or propaganda of a racist, xenophobic, pornographic nature, that advocates terrorism or that violates human rights.
  3. Cause damage to the physical and logical systems of the Owner, its suppliers or third parties, introduce or spread computer viruses or any other physical or logical systems on the network that are likely to cause the aforementioned damage.
  4. Disseminate content that threatens the image and reputation of the Owner or third parties.
  5. Violate the intellectual, industrial, image, honor or other property rights that correspond to the Owner or third parties.

The Owner will have full freedom of decision as to whether the collaborations and messages are finally published on the Website or not, and will be entitled to remove them when he deems appropriate.

The violation of any of the rules contained in these Conditions of use and, especially, of the provisions of this clause, will entitle the Owner to immediately terminate you as a user or subscriber of the Website.

PAYMENT FORMS AND PRICES

The prices of the services are expressed in Euros (€), including taxes and management and shipping costs, the amount of which will be indicated at the time of final confirmation of each order.

Once the data in the form has been completed, the User must proceed to pay for the order through the payment methods specified on the Website.

After payment is made, the User will receive an order confirmation email, which will include a summary of the items purchased, the requested shipping method and the destination address.

If at the time of payment an incident occurs that prevents payment from being made, the User will receive an automatic payment error message and their order will not be processed until the payment process is successfully completed.

DELIVERY TIMES

At this time you can place orders to Spain (Peninsula) and the Balearic Islands. The Canary Islands will soon be opened.

** No charge will be charged for shipping your order when your purchase is greater than €30. When the order is less than €30, €4.50 will be charged for shipping.

Shipments are also made (at a cost of €16) to:

Germany, Austria, Belgium, Bulgaria, Croatia, Denmark, Slovakia, Slovenia, Estonia, Finland, France, Greece, Hungary, Italy, Latvia, Lithuania, Luxembourg, Monaco, Netherlands, Portugal, Czech Republic, Romania and Sweden.

Order delivery ranges between 3-6 business days*

*understanding that Saturdays, Sundays and holidays are not considered business days.

We tell you the usual process from when you place your order:

  1. The warehouse confirms the order (normally within 24 hours)
  2. The next business day the courier picks up the order from the warehouse.
  3. The next day the order would be traveling to your home.

We always try to comply with these periods, but sometimes due to specific situations such as weather, special situations in the different destinations, etc., which depend on external agents, delays may arise, if you have any questions or queries with your order you can write to us  to info@monicaecco.es .

IMPORTANT! Check your order as soon as possible and check that everything is correct.

If you are not at home at the time of delivery, don't worry. The courier will try to call you to arrange a new delivery. If they cannot reach you on the telephone number that you have provided us, they will send you an email or an SMS informing you, you just have to follow the instructions, and you will be able to arrange a new delivery with courier the next day. This new delivery attempt can be made up to a maximum of 2 times, free of charge. If we do not receive a response within this period, your order will be returned to the warehouse of origin and we will refund the amount of your order using the same payment method by which it was paid.

RETURN AND WITHDRAWAL

Withdrawal

As a consumer and user, you have the right to withdraw from this contract within a period of 14 calendar days without the need for justification.

The withdrawal period is 14 days, counting from receipt of the product. To exercise your right, download this form , fill it out and send it to info@monicaecco.es by email.

The return of the goods entails collection costs if it is requested through the courier companies on the website.

The goods must be delivered in their original packaging and in perfect condition.

The refund will be made through the same payment method used by the client for the initial transaction. never later than 14 calendar days after the consumer expresses his desire to exercise the right of withdrawal and once the product has been received in our warehouses in accordance with article 107.1 RDL1/2007. 

Return and exchanges

In the case of orders delivered in Spain (Peninsula) or the Balearic Islands.

To make returns and exchanges of orders you must follow the following process:

  • You have a maximum period of 14 days from the delivery of the order to make the return or exchange.
  • You must send an email to info@monicaecco.es , with the following details:

-Order numbers (they appear in the emails they send you when making the purchase).
-Indicate the product you want to return, if there are several in the order.
-Reason for the exchange or return.

Put the product back in its original box and wrap it before pickup by the carrier. The goods must be delivered in their original packaging and in perfect condition.

We offer you three systems for your possible returns and exchanges:

  • Situation 1

If you are not 100% satisfied with your purchase. For only €6 per item (VAT included), we will send a COURIER to collect your order, so you will not have to travel to make the return, and we will proceed to refund the amount of the item being returned less the return costs.

  • Situation 2

If your problem is that you want to change the number, color or even model, you must carry out the entire procedure as if it were a return, and place an order again for the model you want. They are independent processes, on the one hand, the return is made and on the other, the new order follows its normal course. In this case, there is no charge for return costs for a first exchange, for second exchanges a shipping cost of €6 is applied.

  • Situation 3

Shipping error or product quality problems. If this is your case, it is essential that you send an email with photos of the defect or problem of the shoe to customerservice@monicaecco.es. In this case, the return will have no associated cost, and the customer will be able to decide whether to receive the correct product again or cancel their order and receive 100% of the amount of their purchase.

The refund of the amount, minus any expenses, will be made within a period of no more than 7 business days. The refund will be made through the same payment method used by the client for the initial transaction.

We will not issue a refund if upon arrival at our warehouses it is found that the product has been used.

APPLICABLE LAW, JURISDITION AND CLAIMS

These Terms and Conditions are subject to Spanish legislation. The parties, in accordance with Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, submit to the Courts and Tribunals of the User's place of residence.

Likewise, in accordance with the provisions of Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on the resolution of online consumer disputes, MONICA ECCO informs you that, in the event of a dispute, the User who is a resident of the European Union may go to the “Online Platform for Conflict Resolution” that has been developed by the European Commission, which can be accessed from the following link: http://ec.europa. eu/consumers/odr/

DATA PROTECTION

The information or personal data that you provide us will be treated in accordance with the provisions of the Privacy Policy. By using this website you consent to the processing of said information and data and you declare that all the information or data you provide us is true and corresponds to reality.

MODIFICATIONS

The information that appears on this Website is current on the date of its last update. MONICA ECCO reserves the right to unilaterally modify these Terms and Conditions, as well as its privacy policy and any other information. The entry into force of the modifications to the Terms and Conditions will occur from the moment of their publication on this Website.

LINKS

The Website may include hyperlinks or links that allow access to web pages of third parties other than MONICA ECCO, and which are therefore not operated by MONICA ECCO. These links are provided for informational purposes only, without us having any control over the content of said web pages or materials. We therefore accept no liability for any damage or loss arising from its use.

LEGAL ACTIONS

THE OWNER will pursue non-compliance with these Conditions of Use, as well as any improper use of the Website or its contents, infringements of the rights that correspond to it or its licensors, especially those of Intellectual and Industrial Property, exercising all actions. , civil and criminal, that may correspond to it in Law.
